Competition Terms — Version 2.1
PART A — DEFINITIONS & COMPETITION TERMS
1. Promoter and application of these Terms
The Sweepline website and Sweepline competitions are operated under the Sweepline trading name by Mathis Denanot, entrepreneur individuel (entreprise individuelle), SIRET 84324212400025, whose business address is 114 Cours de la Marne, 33800 Bordeaux, France (the “Promoter”, “Sweepline”, “we”, “us” or “our”). These Terms apply to each person who enters or attempts to enter a Sweepline Edition and to each person who uses the website.
By submitting an entry, you confirm that you have read and accepted these Terms together with the rules and information published for the relevant Edition. You also confirm that the information you provide is complete and accurate.
2. Definitions
In these Terms:
- “Edition” means an individual Sweepline prize draw or competition identified on the website.
- “Edition Rules” means the specific information and conditions published on the relevant Edition page, including the Prize, eligibility, entry price, entry limits, entry method, Free Entry Route, entry availability and draw arrangements.
- “Entrant” means an eligible individual who submits an entry in accordance with these Terms and the Edition Rules.
- “Paid Entry” means an entry obtained through the paid entry process and validly recorded after the applicable payment has been accepted.
- “Free Entry” means an entry submitted through the genuine Free Entry Route described for the relevant Edition and accepted as valid.
- “Valid Entry” means a Paid Entry or Free Entry that complies with these Terms and the Edition Rules and has been accepted into the relevant Edition.
- “Entry ID” means the unique identifier allocated to a Valid Entry for administration and draw purposes.
- “Prize” means the specific prize described on the relevant Edition page.
- “Winner” means the eligible Entrant whose Valid Entry is selected in accordance with the draw process and whose eligibility is subsequently verified.
- “Payment Service Provider” or “PSP” means the third-party payment provider identified during checkout.
3. Edition Rules and order of precedence
Each Edition will have Edition Rules displayed before an Entrant submits an entry. The Edition Rules form part of these Terms. They may contain Edition-specific information including the exact Prize specification, entry price, limits, Free Entry Route instructions, territorial conditions and draw arrangements.
If there is a direct conflict between these general Terms and the Edition Rules, the Edition Rules will take precedence only for the matter that is expressly specific to that Edition. Once an Edition has opened to entries, we will not retrospectively alter its material conditions except where a change is reasonably necessary for legal, regulatory, security, technical-integrity or other exceptional reasons dealt with under these Terms.
4. Eligibility
Unless the relevant Edition Rules state a narrower requirement, Entrants must be aged 18 or over and resident in Great Britain, meaning England, Scotland or Wales. We may require reasonable evidence of age, identity and residence before accepting an entry, administering an account or releasing a Prize.
The following persons are not eligible to enter an Edition: persons directly involved in administering that Edition or its draw on behalf of Sweepline; persons engaged to conduct or supervise the winner-selection process; and their immediate family members where their involvement could reasonably compromise the independence of the Edition.
An Entrant must participate in their own name and must not impersonate another person or use another person's identity to bypass eligibility requirements or entry limits.
5. Paid Entry Route
Where Paid Entries are offered, the Entrant must follow the purchase process shown for the relevant Edition, provide the required information and complete payment using an available payment method.
A payment attempt, cart, pending checkout or payment authorisation does not by itself create a Valid Entry. A Paid Entry is treated as valid only after the payment has been accepted and the entry has been successfully recorded for the relevant Edition. We may issue an order confirmation, Entry ID or other confirmation as evidence of registration.
If payment is refused, cancelled, reversed before settlement or otherwise fails, the associated Paid Entry may not be admitted to the draw. Clause 20 explains how genuine payment disputes and chargebacks are handled.
6. Genuine Free Entry Route
Each Edition operating under the paid-plus-free-entry model will provide a genuine Free Entry Route. No purchase from Sweepline is necessary to use that route. The method, information required, submission instructions and any applicable cut-off or validation requirements will be stated clearly on the relevant Edition page or on the published Free Entry Route page before an Entrant submits a Paid Entry.
The Free Entry Route must be used exactly as described in the Edition Rules or the published Free Entry Route page. Depending on the Edition, the route may use ordinary post or another method expressly stated on the website. Sweepline will not impose a premium postal service or a fee charged by Sweepline merely to submit a Free Entry. An Entrant remains responsible for normal communication or postage costs, if any, associated with the permitted method.
A Free Entry may be rejected only for an objective reason arising from these Terms or the Edition Rules, including missing required information, ineligibility, duplication where the rules prohibit duplicates, use of a prohibited submission method, failure to identify the Edition, or receipt outside the permitted submission period.
A valid Free Entry will be allocated an Entry ID and included in the same winner-selection process as Valid Paid Entries.
7. Equal treatment of Valid Entries
Every Valid Entry included in the final draw is treated equally for winner-selection purposes. A valid Free Entry and a valid Paid Entry each have the same individual chance of being selected. The route by which an entry was obtained must not be used to increase or decrease its chance of selection.
We may retain the source of an entry for audit, reconciliation, fraud-prevention and compliance purposes, but that information will not be used as a winner-selection factor.
8. Entry limits, accounts and circumvention
Any entry limit that applies to an Edition will be displayed in the Edition Rules. Unless expressly stated otherwise, an entry limit applies to the individual Entrant and cannot be avoided by using multiple accounts, email addresses, telephone numbers, delivery addresses, payment cards, devices or other identifiers.
We may combine or review information reasonably necessary to identify attempts to circumvent an entry limit, while applying the same objective rules to all Entrants and respecting applicable data-protection law.
9. Invalid, duplicate, incomplete or misdirected entries
Entrants are responsible for submitting accurate and complete information. We may reject an entry that is illegible, incomplete, materially inaccurate, submitted for the wrong Edition, duplicated contrary to the Edition Rules, submitted through an unauthorised automated process, or otherwise does not satisfy the published rules.
Where reasonably possible, an entry will not be rejected solely because of an internal Sweepline processing error. We will use available records to reconcile affected Paid Entries and Free Entries consistently and fairly.
10. The Prize
The Prize for each Edition will be the item described on the relevant Edition page. For a watch Prize, Sweepline will identify the watch as accurately as reasonably possible using the information available, which may include brand, model, reference, configuration, condition, year or approximate year, bracelet, box, papers and authentication information where applicable.
The public Edition page will use images of the actual Prize where represented as such and will not knowingly describe a stock or illustrative watch as the exact Prize. Serial numbers or other security-sensitive information may be partially obscured where reasonably necessary.
Sweepline is responsible for the Prize obligation. The Payment Service Provider, Shopify and other technology providers do not provide, administer or guarantee the Prize.
The advertised Prize will be supplied unless delivery of that specific Prize becomes objectively impossible because of an exceptional circumstance outside our reasonable control. In that limited situation, and only where permitted by applicable law, Sweepline may provide a substitute of comparable nature and at least comparable value. Any substitution will be explained transparently to affected Entrants.
Unless the relevant Edition Rules expressly offer a cash alternative, no cash alternative is available.
11. Entry register and winner selection
Sweepline will maintain or cause to be maintained a register of Valid Entries for each Edition. Each Valid Entry will be associated with an Entry ID. Before winner selection, the register used for the draw will be reconciled and frozen so that the pool of Valid Entries cannot be altered during the selection process.
The Winner will be selected at random from the Valid Entries using a verifiably random computer process, an independent third-party random-number system, independent supervision, or another auditable method described in the Edition Rules.
Sweepline will retain a reasonable audit record of the draw, which may include the frozen entry register or a protected export, draw output, certificate, timestamped record or other evidence sufficient to demonstrate how the winning Entry ID was selected.
Administrative decisions about whether an entry complies with these Terms will be made in good faith, reasonably and consistently. Nothing in these Terms gives Sweepline an unrestricted right to disregard the published rules, alter the result or override rights that apply by law.
12. Winner contact and verification
The selected Entrant will be contacted using the contact information supplied with the relevant entry or account. Before the Prize is released, Sweepline may require reasonable evidence of identity, age, Great Britain residence and compliance with the Edition Rules.
For a winning Paid Entry, we may also request reasonable evidence that the payment was validly made or authorised. A Free Entry does not require proof of purchase or payment.
The selected Entrant must respond and provide any reasonably requested verification within the reasonable period specified in our notification. If the selected Entrant is ineligible, cannot verify their identity or eligibility, cannot be contacted after reasonable attempts, expressly declines the Prize, or otherwise fails to satisfy the published rules, the entry may be disqualified and a replacement winner selected using the same draw principles.
Entries are personal to the Entrant and are not transferable unless the Edition Rules expressly state otherwise.
13. Prize delivery
After the Winner has been verified, Sweepline will arrange secure delivery or another agreed handover method in accordance with the Edition Rules. Where delivery is included, we may use an insured courier and require identification, signature or other reasonable proof of receipt.
The Winner must provide accurate delivery details and cooperate with reasonable security and delivery arrangements. Estimated delivery periods are not guarantees, but Sweepline will take reasonable steps to complete fulfilment without unnecessary delay.
14. Publicity and winner content
We may invite the Winner to take part in reasonable publicity such as photographs, interviews or a filmed Prize handover. Participation in optional marketing publicity is not a condition of entitlement to the Prize unless a specific legal requirement or an expressly disclosed and lawful Edition condition provides otherwise.
Any personal data, image or recorded content will be handled in accordance with our Privacy Policy and applicable data-protection law. Where consent is the legal basis for publicity, consent may be withheld or withdrawn in accordance with applicable law.
15. Responsible participation and account controls
Sweepline may apply reasonable participation or spending controls, account restrictions and security checks designed to support responsible participation and protect Entrants. Available limits or controls may be described on the website or relevant Edition page.
An account holder may contact sweepline41@gmail.com to request suspension or closure of their account or restriction of future paid participation. We may also suspend or restrict an account where reasonably necessary for age or identity verification, fraud prevention, security, compliance or responsible-participation concerns.
Restrictions must not be circumvented by creating additional accounts or using another person's details.
16. Fraud, bots and abusive conduct
You must not manipulate or attempt to manipulate an Edition, the website, payment process, Free Entry Route, entry register or draw. Prohibited conduct includes bots, scripts, bulk automated entry systems, unauthorised scraping used to submit entries, false identities, forged documents, payment fraud, collusion, technical interference and deliberate use of multiple accounts to evade published limits.
Where we have reasonable evidence of prohibited conduct, we may suspend the affected account, investigate, reject or remove affected entries and take other proportionate measures permitted by law. A genuine Free Entry will not be rejected merely because it was submitted without making a purchase.
17. Technical errors and reconciliation
If a payment is successfully accepted but an expected Paid Entry or Entry ID is not created because of a technical error, Sweepline will use transaction and system records to investigate and, where reasonably possible, reconcile and register the correct entry. If an entry cannot lawfully or reliably be validated, any associated payment will be handled in accordance with the refund provisions and applicable law.
If a valid Free Entry is affected by an internal processing error, we will use available evidence to investigate and apply the same validation standards used for other entries. We will not intentionally disadvantage a Free Entry because it did not involve payment.
Temporary unavailability of a PSP, checkout, website or other service may cause us to pause new submissions while the issue is investigated. It does not, by itself, invalidate Valid Entries already recorded.
18. Exceptional changes and cancellation
Sweepline may change, suspend or cancel an Edition only where reasonably necessary and permitted by law, including in response to a legal or regulatory requirement, serious fraud or security concern, material technical failure affecting the integrity of the Edition, loss or destruction of the Prize where replacement is not reasonably possible, or another exceptional circumstance outside our reasonable control.
Any action taken will be limited, so far as reasonably practicable, to what is necessary to protect the fairness and integrity of the Edition. Material changes will be communicated to affected Entrants in a reasonably prominent manner. We will retain an appropriate record of the change and its reason.
If an Edition is cancelled, the treatment of affected Paid Entries, refunds and Free Entries will be explained to affected Entrants and handled in accordance with applicable law and these Terms.
PART B — PAYMENTS, REFUNDS & PHYSICAL GOODS
19. Payment processing and Viva.com
Online payments are processed by the Payment Service Provider identified during checkout. Where Viva.com is displayed as the payment provider, the payment transaction is processed through Viva.com's payment services. Sweepline remains responsible for the Edition, entry administration, Winner selection and Prize fulfilment.
Viva.com, any other PSP, card scheme, bank, Shopify or checkout technology provider is not the promoter, sponsor, administrator, judge or guarantor of a Sweepline Edition merely because its services are used. References to a payment provider do not imply that the provider endorses or has certified Sweepline's competition model.
The availability of any payment method is subject to the PSP's technical availability, risk controls, terms and continued willingness to provide the relevant payment service. We may add, remove or temporarily disable a payment method where reasonably necessary without affecting Valid Entries already recorded.
A PSP, issuer or Sweepline may apply authentication, 3-D Secure, identity, fraud-prevention, sanctions or transaction-risk checks where required or reasonably necessary. A transaction that is refused or not completed does not create a Paid Entry.
20. Refunds, payment reversals and chargebacks
Subject to applicable law and the relevant Edition Rules, a correctly submitted and validly paid competition entry is not ordinarily refundable merely because an Entrant changes their mind. This does not exclude any statutory consumer right or other refund right that cannot legally be restricted.
Refunds may be appropriate in circumstances including a duplicate or incorrect charge, an error attributable to Sweepline, cancellation of an Edition, a transaction that cannot be reconciled to a valid entry, or another circumstance in which applicable law or these Terms require a refund.
Entrants retain their legitimate rights to challenge unauthorised, duplicated, incorrect or otherwise genuinely disputed transactions. A genuine payment dispute is not, by itself, treated as misconduct.
If a payment connected with a Paid Entry is lawfully reversed, cancelled or charged back and is no longer validly settled, the affected Paid Entry may be suspended or removed where appropriate and permitted by law. Fraudulent, abusive or knowingly unjustified chargebacks may lead to proportionate account restrictions or refusal of future Paid Entries. A chargeback relating to one payment does not automatically invalidate a separate valid Free Entry held by the same Entrant.
If you believe a charge is incorrect, you may contact sweepline41@gmail.com so that we can investigate, without limiting any right you have to contact your bank or payment provider.
21. Physical goods ordered with an Edition
If an order includes a physical product, such as apparel or merchandise, rights and obligations relating to that physical product are separate from the rules governing the associated competition entry. Nothing in these Terms removes mandatory consumer rights that apply to physical goods, including rights relating to goods that are faulty, not as described or otherwise protected by applicable law.
The description, price, delivery and any return conditions for a physical product will be stated on the relevant product page or applicable policy. A refund, return or dispute concerning physical goods will be assessed separately from the validity of competition entries except where the two are legally or technically inseparable.
PART C — RESULTS, DATA, COMPLAINTS & LEGAL PROVISIONS
22. Publication of results
Sweepline may publish a reasonable record of an Edition result for transparency, which may include the Edition identifier, winning Entry ID, draw method and limited information about the Winner. Personal information will be limited to what is lawful and appropriate under our Privacy Policy and applicable data-protection law.
23. Records and audit evidence
We may retain entry records, payment references, validation records, draw evidence, Prize-fulfilment records, complaints and related correspondence for as long as reasonably necessary for administration, audit, fraud prevention, dispute resolution, legal obligations and enforcement of these Terms. Personal information is retained and handled in accordance with our Privacy Policy.
24. Complaints
If you have a complaint about an Edition, entry, payment, draw, Prize or our service, contact sweepline41@gmail.com. Please provide your name, relevant order or Entry ID where available, the Edition concerned and enough detail for us to understand the issue.
We will acknowledge, investigate and respond within a reasonable time. If you are dissatisfied with the initial outcome, you may request an internal review by replying to the written response and explaining the issue you believe remains unresolved. Nothing in this process restricts any statutory right or right to use a competent court, regulator, payment dispute mechanism or other remedy available under applicable law.
25. Rolex and other trade marks
Sweepline is an independent business. Unless expressly and accurately stated otherwise, Sweepline is not sponsored, endorsed, administered by, associated with or affiliated with Rolex SA or its affiliated companies. Rolex, Datejust and other third-party names, marks and product identifiers remain the property of their respective owners and are used only as reasonably necessary to identify or describe a Prize.
26. Privacy
Personal information is handled in accordance with our Privacy Policy and applicable data-protection law. This includes information used to administer accounts and entries, conduct eligibility checks, prevent fraud, reconcile payments, select and verify Winners, arrange Prize delivery, keep audit evidence and handle complaints.
27. Liability and mandatory consumer rights
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.
Subject to mandatory consumer rights, Sweepline is not responsible for loss or damage where there has been no breach of a legal duty owed by us, where the loss was not reasonably foreseeable when the relevant contract was formed, where it results from the Entrant's own acts or omissions, or where it relates to business use and the law permits exclusion of such business losses.
Nothing in these Terms permits Sweepline to retain a Prize, cancel a valid consumer right or avoid an obligation simply because a third-party provider, including a PSP or technology supplier, is involved in providing part of the service.
28. Severability and transfer
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply so far as legally possible. Sweepline may transfer its rights or obligations to another organisation where lawful, provided that doing so does not reduce mandatory consumer protections or materially prejudice an existing Entrant's rights.
29. Governing law and courts
These Terms are governed by English law to the extent that choice is legally permitted. Nothing in this clause deprives a consumer resident in Scotland or elsewhere of any mandatory rights, protections or rights to bring proceedings before a competent court that cannot lawfully be excluded or restricted.
PART D — WEBSITE TERMS
30. Website use
The Sweepline website is operated by the business identified at the top of these Terms. You may use the website only for lawful personal purposes and in accordance with these Terms and our Acceptable Use Policy.
Information on an Edition page, product page, checkout or other part of the website should be read together with the applicable Edition Rules. We aim to keep information accurate and current but may correct genuine typographical, technical or factual errors, provided that any correction affecting an open Edition is handled in accordance with the exceptional-changes provisions above.
31. Prohibited website use
You must not:
- breach applicable law or another person's rights;
- use the website for fraud, impersonation, unauthorised promotions, spam or unlawful conduct;
- damage, overload, disrupt or interfere with the website, entry register, checkout, systems or networks;
- seek unauthorised access to accounts, systems, servers, data or networks;
- introduce malware or harmful code;
- use bots, scripts, scraping tools or automated means to submit entries or manipulate availability unless expressly authorised by Sweepline;
- assist another person to do any of the above.
32. Third-party websites and services
The website may integrate with or link to third-party services including payment providers, ecommerce technology, couriers, social networks, authentication providers and independent draw services. Those third parties may have their own terms and privacy notices. A link or integration does not by itself mean that Sweepline controls or guarantees the third party.
Sweepline remains responsible for obligations that the law or these Terms place on Sweepline and does not transfer responsibility for administering an Edition merely by using a third-party service.
33. Website availability and accounts
We do not guarantee uninterrupted access to the website. Maintenance, technical faults, security incidents or matters outside our reasonable control may cause temporary disruption. We will seek to minimise disruption where practicable and will handle any effect on an Edition under the technical-error and exceptional-changes provisions above.
Where user accounts are available, an account is personal to the registered user. You must keep passwords and access credentials confidential. If you know or suspect that another person has accessed your account without permission, contact sweepline41@gmail.com promptly.
34. Intellectual property
Unless otherwise stated, the Sweepline website and its original text, graphics, photographs, videos, branding, design and software are owned by or licensed to Sweepline or their respective rights holders and are protected by intellectual-property laws. You may use the website for personal, lawful purposes but must not reproduce, distribute, commercially exploit, modify or republish protected material without the relevant rights holder's permission.
35. Changes to these general Terms
We may update these general Terms for future use by publishing a revised version. A revised version does not retrospectively remove or reduce material rights attached to a Valid Entry already accepted for an Edition, except to the limited extent a lawful exceptional change is required under clause 18.
The version number displayed at the top of this page identifies the current general Terms. Entrants should retain a copy of the Terms and Edition Rules applicable when they enter.
